These Terms of Service (“Terms”) govern your use of the ZapYaw app and related services (“ZapYaw”, the “Service”). In these Terms, “we”, “us”, and “our” refer to ZapYaw. By creating an account or using ZapYaw, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use ZapYaw. By using the Service, you confirm that you meet this requirement and that you can form a binding agreement with us.
2. Your account
- You register using your phone number, and you are responsible for keeping access to that number and your device secure.
- You are responsible for the activity that occurs under your account.
- You agree to provide accurate information and to keep it up to date.
- Notify us promptly if you believe your account has been used without your permission.
3. Acceptable use
You agree not to use ZapYaw to:
- Break any applicable law or regulation, or infringe the rights of others.
- Send spam, or harass, threaten, abuse, or harm other people.
- Distribute malware or attempt to disrupt, overload, or gain unauthorized access to the Service or its servers.
- Share content that is illegal, hateful, sexually exploitative of minors, or otherwise objectionable.
- Impersonate any person or misrepresent your affiliation with anyone.
- Reverse engineer, scrape, or misuse the Service except as permitted by law.
We may suspend or terminate accounts that violate these Terms.
4. Your content
You retain ownership of the messages, media, and other content you send through ZapYaw. You are solely responsible for your content and for ensuring you have the rights to share it. You grant us the limited permission necessary to transmit, store, and display your content for the purpose of operating the Service.
5. Fees and advertising
ZapYaw is currently free to use. We may introduce limited advertising and/or optional paid features in the future. If we do, we will make the applicable terms and pricing clear at that time, and any advertising will be handled as described in our Privacy Policy.
6. Service availability and changes
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms; continued use after changes take effect means you accept the updated Terms.
7. Termination
You may stop using ZapYaw and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or its users.
8. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
9. Limitation of liability
To the maximum extent permitted by law, ZapYaw will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, messages, or profits, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the twelve months before the claim.
10. Indemnification
You agree to indemnify and hold harmless ZapYaw and its operators from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.
11. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. You agree that the state and federal courts located in Delaware shall have exclusive jurisdiction over any dispute arising from these Terms or your use of the Service.
